Terms of Service

1. Purpose and acceptance

These Terms of Service (ToS) govern the use of the eTaalim platform, a service connecting students and teachers for online tutoring.

Access to and use of the platform are conditional on full acceptance of these ToS. By creating an account or using the services, the user acknowledges having read, understood and accepted these terms. If you do not agree, you must not use the platform.

2. Publisher and hosting

The eTaalim platform is published by the company operating the service, whose contact details are available on the site's Contact page.

Data and services are hosted by providers compliant with applicable regulations. The publisher undertakes to implement appropriate technical and organisational measures to ensure the security and confidentiality of data.

3. Description of services

eTaalim offers online tutoring (individual or group), organised by subject and level, with sessions held by video conference (e.g. Zoom). Sessions may be recorded so that students can review them from their personal space.

Services include course booking, enrollment management, payment processing, access to a dashboard (student or teacher) and related features. The publisher reserves the right to evolve, modify or discontinue all or part of the services, subject to prior notice to users where required by law.

4. Registration and user account

Use of certain services (booking, payment, access to courses) requires creating an account. The user agrees to provide accurate, complete and up-to-date information and to keep login details confidential.

The user is responsible for all activity from their account. In the event of unauthorised use or loss of credentials, they must notify the publisher without delay. Accounts are personal and non-transferable.

5. Course enrollment, bookings and payment

Bookings and course enrollments are made online via the platform. Prices are displayed before any confirmation and may vary according to the type of course (individual or group) and the chosen plan.

Payments are made by credit/debit card (including international cards), bank transfer or other means offered on the platform, via secure payment providers. Payment constitutes acceptance of the price and conditions of the course or class. Invoices or receipts may be issued on request or as required by law.

6. Cancellation, rescheduling and refunds

Cancellation and rescheduling terms (deadlines, procedures) are specified at the time of booking or in the course or class information. As a rule, cancellation or rescheduling may be possible up to 24 hours before the session, subject to specific applicable rules.

Refund policies are defined per course or class and communicated before commitment. Where a refund is accepted, it will be processed according to the timeframes and procedures of the payment provider and the publisher. The publisher cannot be held responsible for payment failures due to the card (limit, e-commerce authorisation, internet payment disabled); the user should check settings with their bank.

7. User obligations and code of conduct

The user agrees to use the platform in good faith, in compliance with applicable laws and these ToS. The following are prohibited: harassment, discriminatory, defamatory or illegal statements, distribution of content contrary to public order or morality, fraud, identity theft, and any practice likely to harm the service or others.

Exchanges during sessions (video conference, messaging) must remain courteous and consistent with an educational framework. Non-compliance may result in a warning, suspension or termination of the account, without prejudice to any legal action.

8. Intellectual property

The eTaalim platform, its content (texts, graphics, logos, structure, databases, software) and associated trademarks are protected by intellectual property law. The publisher owns or holds the necessary rights.

Use of the platform does not grant the user any ownership of these elements. Reproduction, representation, exploitation or extraction of any part of the content or features of the platform, for commercial or other purposes, is prohibited without prior written consent. Session recordings are for personal revision only; unauthorised distribution or use is prohibited.

9. Personal data

Personal data collected in connection with the use of the platform is processed in accordance with the General Data Protection Regulation (GDPR) and applicable law. It is used to provide services (account management, bookings, payments, notifications, access to courses and recordings), to improve the service and, where applicable, to comply with legal obligations.

Rights of access, rectification, erasure, restriction of processing and portability may be exercised as set out in the Privacy Policy. For any questions, the user may contact the publisher via the Contact page.

10. Liability and warranties

The publisher endeavours to ensure the availability and security of the platform but cannot guarantee uninterrupted availability. It cannot be held liable for indirect damage (loss of data, loss of opportunity, commercial loss, etc.), or for malfunctions attributable to third parties (network, user equipment, payment providers) or to non-compliant use of the services.

Responsibility for teaching content and the conduct of sessions lies with teachers and users in the context of their relationship. The publisher acts as an intermediary for matching and technical management of the service.

11. Duration, termination and suspension

These ToS apply for the entire period of use of the platform. The user may close their account at any time via their account settings or by contacting the publisher.

The publisher reserves the right to suspend or terminate an account in the event of breach of the ToS, harmful behaviour or upon request by authorities. Upon termination, provisions already performed (courses already delivered or paid in accordance with applicable rules) remain binding; amounts due remain payable.

12. Changes to the terms

The publisher may modify these ToS to reflect legal, technical or service changes. Users will be informed of material changes by any appropriate means (notification on the platform, email).

Continued use of the platform after the changes take effect constitutes acceptance of the new terms. If you do not agree, you must stop using the service and may request closure of your account.

13. Governing law and disputes

These ToS are governed by the law applicable at the publisher's registered office (in particular French and/or Moroccan law as the case may be). In the event of a dispute, an amicable solution will be sought before any legal action.

Failing amicable resolution, the courts having jurisdiction shall be those designated by law. For consumers residing in the European Union, the provisions on jurisdiction and applicable law under applicable texts remain applicable.
